1. About these terms

These terms are between you and [Company name and legal form] (“Panko”). By creating an account or using the Panko website, apps or service you agree to them. If you do not agree, do not use Panko.

2. What Panko is

Panko lets caregivers see glucose and status data from a Panko insulin pump and a glucose sensor, receive alerts, and, where permitted, send commands to the pump. Panko is a monitoring and remote-management tool. It does not give medical advice, does not replace your diabetes care team, and is not an emergency service.

3. Safety, and your responsibility

Insulin therapy carries risk, and Panko depends on the sensor, the pump, networks, servers and your phone, any of which can fail or be delayed. Read the safety information at panko.bg/safety and follow it. In particular: do not rely on Panko as the only way of noticing a problem, check the real pump and sensor when a reading looks wrong, wait for the pump to confirm a command, and call your local emergency number in an emergency.

You are responsible for the decisions you make using Panko, and for the care of the person you look after.

4. Who may use Panko

You must be at least 18 and able to enter a binding agreement. A person under 18, or who cannot manage their own account, may be a patient, but only through a parent, guardian or other legal representative who accepts these terms for them.

5. Your account

  • Give accurate information, confirm your email address and keep your password private.
  • You are responsible for what happens under your account. Tell us at once if you think it has been misused.
  • Only add or link a patient you are entitled to care for, and only give other people the role they need.

6. Acceptable use

You must not:

  • use Panko unlawfully, or to harm or deceive anyone;
  • try to access data or accounts that are not yours, or bypass any security or access control;
  • disrupt or overload the service, or reverse-engineer it except where the law allows;
  • send commands to a pump you are not authorised to control.

7. Access and roles

Each patient has an owner, who decides who else can view or control the pump. Owners and admins can invite and remove other caregivers. The owner cannot be removed. Panko may restrict an action that would be unsafe or that breaks these terms.

8. Availability and changes

We work to keep Panko running, but we do not promise it will always be available, uninterrupted or error-free. We may change, suspend or end features, and we will try to tell you in advance about changes that matter for safety.

9. Your data

You keep ownership of your data. You allow us to process it to run the service, as set out in the privacy policy. We do not sell it.

10. Our rights in Panko

Panko, its software, design and name belong to us or our licensors. You may use them to use the service, but not to copy, sell or build a competing service from them.

11. Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for intent or gross negligence. Subject to that, and to the extent the law allows, Panko is provided “as is”, and we are not liable for losses that were not reasonably foreseeable, or that result from the failure of a sensor, pump, network, phone or other service outside our control, or from not following the safety information.

12. Suspension and ending

You can stop using Panko and close your account at any time. We may suspend or close an account that breaks these terms or puts safety or security at risk. Sections that by their nature should continue to apply after that will do so.

13. Changes to these terms

We may update these terms. If a change matters, we will tell you in the app or by email before it applies. Continuing to use Panko after that means you accept the new terms.

14. Law and disputes

These terms are governed by the law of Bulgaria. Disputes go to the competent courts in Bulgaria, without affecting any mandatory consumer rights you have in your own country.
